Artz, Esq., and Michael J. McCarrie, Esq., have been partnered together for over 15 years. While Mr. Artz attends and maintains the Harrisburg office, Mr. McCarrie resides at the Media office interacting with the clients and maintaining litigation.
Michael J McCarrie Esquire
Mr. McCarrie is currently a partner at the Artz McCarrie Health Law. He resides at the firm’s office in Media, and routinely practices in the areas of Health Care Fraud and Compliance, White Collar Criminal Defense, licensing of healthcare professionals, credentialing, medical, nursing, pharmaceutical and chiropractic board related investigations and disputes.
Mr. McCarrie has handled a wide variety of white collar criminal cases across the country, including Health Care Fraud, Medicare and Medicaid Fraud, pharmaceutical and FDA related matters and criminal investigations. His clients include physicians, pharmacists, nurses, physical therapist, chiropractors, and their practices.
Mr. McCarrie routinely represents physician practices, health care entities and providers in civil litigation, such as: the defense of RICO and fraud suits; overpayment, billing, and reimbursement disputes; Recovery Audit Contractor (“RAC”) disputes and Medicaid Integrity Program audits; Medicare reimbursement appeals; and issues involving employment terminations, restrictive covenants, and other healthcare related business disputes. He also litigates a broad range of other civil matters including contract actions, employment disputes and allegations of statutory or common law fraud.
Mr. McCarrie is a member of the American, Pennsylvania and Philadelphia Bar Associations. He is also a member of the American Health Lawyers Association and the Pennsylvania Association of Criminal Defense Lawyers.
Mr. McCarrie speaks extensively on white collar and health care litigation issues, including fraud, abuse and compliance. He regularly lectures at the PBI Health Law Institute.
Mr. McCarrie began his legal career in the Philadelphia District Attorney’s office in the Felony Jury and Career Criminal Units. Thereafter he worked at Cozen O’Connor where he was a Partner in the Arson and Fraud Unit. As the son of a distinguished Philadelphia Police Captain he has intricate experience concerning law enforcement matters. He is the former Senior Fraud Counsel at Independence Blue Cross and author of the Fraud Manual.
Mr. McCarrie received his J.D., from the Widener University School of Law. He earned his B.A., from Wilkes University. (He has practiced in both Federal and State Courts in Pennsylvania, New York and New Jersey. He is licensed in Pennsylvania.)
Charlie I. Artz Esquire
Mr. Artz is the managing partner of Artz McCarrie Health Law. He concentrates his practice on health law, representing physicians, physician organizations and other providers in fraud and abuse, Stark and Anti-kickback compliance, fraud and abuse, Stark and Anti-kickback defense, false claims act defense litigation, government and commercial third party payer post-payment and RAC audit defense, State Board of Medicine licensure matters, medical staff privileges litigation, HIPAA privacy and security compliance, and medical practice related business transactions and employment issues. He has drafted and implemented compliance plans for numerous medical specialty practices, multi-specialty and multi-disciplinary practices, and physician practice management companies.
He has negotiated and represented health care providers in carrier and government overpayment audit and refund cases, health care false claims and fraud defense cases before federal and state authorities, defended OCR privacy investigations and has analyzed and structured institutional and individual provider arrangements to establish compliance with state and federal anti-referral and anti-fraud and abuse statutes and regulations. He has briefed or argued over 30 cases in Pennsylvania’s state and federal appellate courts, including a successful argument before the Pennsylvania Supreme Court. He serves as general counsel to the Pennsylvania Academy of Family Physicians, Health Law Counsel to the Pennsylvania Orthopedic Society and represents scores of medical practices throughout Pennsylvania and multiple other jurisdictions.
He writes bi-monthly articles on health law and policy issues in Keystone Physician, PAFP’s bi-monthly publication. He has also published articles in Physicians News Digest. He has made numerous presentations to physicians on various compliance, fraud and abuse, HIPAA privacy, reimbursement and managed care topics.
Mr. Artz received a Bachelor of Science degree, cum laude, from Elizabethtown College, and a J.D. degree from The Dickinson School of Law. He is admitted to practice law before the U.S. Supreme Court, Pennsylvania Supreme Court, all Pennsylvania civil and appellate courts, the U.S. District Court for the Middle District of Pennsylvania, and the U.S. District Court for the Eastern District of Pennsylvania.
